Changes declared in the Building Coefficient for developments in urbun areas

Clarifications for the application of the famous article 10 of the New Building Regulation were provided by the Ministry of Environment

Clarifications for the application of article 10 of law 4067/12 (NOK) are given by the Ministry of Environment in a recent circular signed by the Secretary General of Spatial Planning and Urban Environment Mr. Efthymios Bakogiannis.

It is been reminded that article 10 of the New Building Regulation (law 4067/12) provides incentives for environmental upgrading and improving the quality of life in densely populated and urban areas such as areas of Attica, Patras, Larissa, Heraklion, Volos and others.

In these areas it is possible to increase the building coefficient in proportion to the percentage reduction of the allowed percentage of land coverage. This percentage can reach up to 25% in case of return of part of the plot or its roof to public use or the withdrawal of the existing building with an area of ​​at least one quarter of the existing allowed building factor of the area.

According to the clarifications of the new circular of the ministry, the benefits of the law are applied in cases of plots whose area is larger than the perfection of the area.

In case no perfection is defined in the area, for the calculation of the factor B, as a plot area is taken the total area of ​​the joined allotted plots and as a rule perfection of the area, the area of ​​the smallest of them is taken.

In the case that perfection has been determined in the area, the coefficient B results as the quotient of the total area of ​​the combined allotted plots to the perfection of the area as a rule.

It goes without saying that in the event that the area of ​​the allotted plot is larger than the perfection of the area, there is no obligation for the application of article 10 to join an adjacent plot.

Regarding the case of plots that contribute to the common public use of 100% of the uncovered and which are given the possibility to increase the permitted construction of the resulting plot by 35% by adding up to 30% in addition to the permitted area it is clarified that this due increase of the amount up to 30% is applied to the amount that is valid in the area based on its initial SD according to article 15 of the NOK and not that which corresponds to the increased SD after the application of article 10.

It is obvious that in the areas where the height is defined by special urban planning provisions numerically and not in relation to the SD, the increase of the height is allowed only by one meter.

Finally, it is pointed out that the incentives for the environmental upgrade and improvement of the quality of life in densely populated and urban areas are provided after the consent of the relevant Architecture Council.
