The Ministry of Environment and Energy issued a clarifying announcement regarding the suspension of building permits.

As pointed out in the announcement, the suspensions of building permits - in addition to the cases of suspension of construction work on a specific property by virtue of a court decision or automatically of 52A of the PD. The 18/89- apply only to the areas for which there is a relevant provision of the law or a decision of the Minister of Environment and Energy under the authorization of a provision of the law.

Any other decision, originating, for example, from the Local Government, has no institutional force.

In order to avoid misunderstandings regarding the implementation of the incentives provisions of the New Building Regulation (NOK), the ministry has set up an unpaid working group for the review of the incentives of the NOK in order to analyze the effectiveness of the existing criteria in their application, to review the conditions their implementation, and finally to propose new ones or to oppose the existing ones.

The Working Group, which has a suggestive role towards the political leadership and in any case not a decisive one, is expected to include in its examination the data that will arise from upcoming decisions of the Plenary of the Council of State regarding provisions of the NOK.

It is recalled that the decision of the 5th Department of the Council of Ministers, on the occasion of an appeal for building permits in the Municipality of Alimos, concerns the urban planning acquis of the application of the cancellation of basic provisions of the NOK, for new and existing building permits, in all urban areas in the centers and the periphery of the country. The decision of the 5th Department of the Council of State with number 310/2024, issued on February 6, 2024 refers for a final judgment to the Plenary, "due to the importance of the issues raised".

As stated in the announcement pending the judgment of the Supreme Court, the Ministry of Environment and Energy does not have in its immediate intentions, prior to the issuance of the relevant decision, undertaking a relevant legislative initiative and clarifies that the provisions of the NOK continue to be applied, as they are .
