Extended deadlines for building regularization and building identity

New deadlines introduced by the Ministry of Environment and Energy amendment.

The amendment submitted by the Ministry of Environment and Energy to a bill of the Ministry of the Interior provides for significant extensions to critical urban planning deadlines, as well as facilitation measures for the implementation of energy storage projects.

The amendment was incorporated into the bill entitled “Provisions on Human Resources in the Public Sector, Civil Society Organizations, the Strengthening of Local Government, the National Registry of Companion Animals, and Other Provisions”. It introduces measures affecting both real estate owners and investors in the energy sector.

More specifically, Article 3 of the amendment (paragraphs 2–6) establishes urgent provisions aimed at facilitating citizens’ transactions and preventing further disruptions in the real estate market:

Extension of the suspension of sanctions:

The deadline for the suspension of sanctions under Article 125Θ of Law 4495/2017 is extended for buildings with annulled building permits, insofar as this relates to the use of urban planning incentives and bonuses (NOK incentives). The suspension remains in effect until the final deadline for submitting an application for the reissuance of a building permit via the “e-Permits” system. In parallel, the suspension of prohibitions on legal transactions is also extended, thereby allowing transfers, sales, and the establishment of real rights. It is clarified that no procedure may be extended beyond 31 December 2026.

  • Building Identity: The deadline for the preparation and submission of the Building Identity for Category I buildings is extended until 1 February 2028.
  • Regularization of unauthorized constructions: An extension is granted until 31 March 2028 for the regularization of unauthorized constructions and changes of use classified under Categories 1 to 4, provided they were carried out prior to 28 July 2011.
  • Maritime facilities: The permissibility of onshore facilities used for the winter storage and minor repair of vessels is extended until 31 March 2027.
  • Demolitions: The mandate of the currently competent authorities to execute demolition protocols is extended until 30 June 2026.

Extension for energy storage stations

Article 4 of the amendment provides an extension for the activation of Electricity Storage Stations (ESS) that have been selected for inclusion in a support scheme through competitive procedures. In particular, due to delays encountered during project implementation, the deadline for the activation of ESS approved under the third competitive procedure is extended until 30 June 2026. This measure aims to safeguard the smooth progression of investments and prevent the loss of financial support.

Through these extensions, the Ministry of Environment and Energy seeks to provide substantial relief to hundreds of thousands of property owners and professionals, preventing the emergence of new bottlenecks in the real estate market and facilitating the transition to the new urban planning framework. At the same time, the measures enhance legal certainty and reinforce the credibility of the regulatory framework during a period of heightened demands in both the real estate and energy investment sectors.
