Among the issues under consideration are matters concerning the imminent expiration of legal deadlines related to building identity documents, regularization of unauthorized constructions, extensions of building permits, and similar topics.
Specifically, to expedite property transfers, POMIDA proposes legislation allowing the immediate transfer of properties with the obligation for the buyer to obtain an electronic building identity document within nine months from the date of signing the transfer deed, under conditions that fully ensure compliance with the law.
According to POMIDA, the key issues for property owners are:

Establishment of clear building regulations for both urban and non-urban areas across the country.

Extension of all building permits until December 31, 2026.

Implementation of a permanent procedure for the regularization of unauthorized constructions after March 31, 2026, including those classified as category 5, with stricter conditions and special rules, as well as for forest-related unauthorized structures.

Acceleration of the process for adjudicating objections to forest maps.

Activation of the Transfer of Building Factor mechanism.

A three-year extension for the issuance of building identity documents for private buildings of public interest, currently set to expire on January 31, 2026.
Furthermore, POMIDA requests that immediate property transfers be allowed by shifting the responsibility for regularizing any unauthorized structures to the buyer, who will undertake the obligation to issue the electronic building identity document within nine months from the date of signing the transfer deed, subject to the following conditions:

The buyer must provide a solemn declaration in the deed committing to timely completion of the lawful procedure for obtaining the building identity document, bearing sole expense, responsibility, and diligence.

The buyer must submit to the notary a guarantee letter amounting to 10% of the property's value, refundable upon completion of the procedure.

Should the buyer fail to comply, the guarantee letter will be forfeited to the State, and any further transfer or any other real rights transaction involving the property will be void for as long as the building identity document is not issued.
